Commercial Guarantee Contract

1. Scope of the commercial guarantee

The commercial warranty applies to all products purchased on www.relo.top
It is valid for a period of 12 months from the delivery date , unless otherwise indicated in the product sheet.

This warranty is in addition to the buyer's legal rights. During this period, the seller undertakes to guarantee the absence of defects of conformity and breakdowns, and to:

  • Respond to any complaint within 24 hours (excluding weekends and public holidays);
  • Provide a free return label within 3 working days of receiving the request by email, allowing for return from mainland France. Return costs are the responsibility of the seller;
  • Offer a repair or replacement within a maximum of 7 working days after receipt of the product;
  • Bear the shipping costs associated with the repair or replacement;
  • Issue a refund only if repair or replacement is not possible, at the buyer's discretion (full refund if returned or partial refund if kept).

The commercial guarantee is provided free of charge .

2. Exclusions from the commercial warranty

The commercial guarantee does not cover:

  • Oxidation, breakage or physical damage;
  • Interventions by the buyer or an unauthorized third party;
  • Abnormal use or use not in accordance with the usual use of the product;
  • The return of a product that does not correspond to the only device delivered;
  • Damage due to negligence, lack of maintenance or accident after delivery (e.g. fall);
  • Normal wear and tear of the product.

3. Implementation of the guarantee

To benefit from the commercial guarantee, the buyer must:

  • Contact the seller via email and submit a complaint;
  • Carefully package the product to avoid damage during transport;
  • Delete your personal data and disconnect any account linked to the product before returning it.

4. Insurance and coverage

This commercial guarantee does not constitute insurance .
It does not include loss or theft of the product.

The buyer can separately take out paid insurance covering breakage and theft.

5. Legal Rights

The commercial guarantee is in addition to the legal guarantees provided for by French law, and does not affect them in any way.

6. Applicable law and mediation

This contract is subject to French law .
In the event of a dispute, the buyer may have recourse to a consumer mediator free of charge, in accordance with the terms and conditions set out in the General Conditions of Sale.

Annex – Applicable legal provisions

A. Legal guarantee of conformity (Consumer Code, art. L.217-1 to L.217-32)

  1. The consumer has a period of 2 years from delivery of the goods to obtain the implementation of the legal guarantee of conformity.
  2. During this period, the consumer does not have to provide proof of the date of appearance of the defect.
  3. When the sales contract relates to the continuous supply of digital content or service for a period exceeding 2 years, the guarantee applies for the entire supply period.
  4. The professional must provide all updates necessary to maintain the conformity of the property.
  5. In the event of a defect, the consumer has the right, free of charge and within 30 days , to the repair or replacement of the goods, without major inconvenience.
  6. If the goods are repaired under this warranty, the consumer benefits from a 6-month extension of the initial warranty.
  7. In the event of replacement, a new period of 2 years runs from the date of delivery of the replaced item.
  8. The consumer may obtain a price reduction or termination of the contract in the following cases:
  • refusal of the professional to repair or replace;
  • failure to comply within 30 days;
  • major inconvenience caused by repair/replacement;
  • persistent defect despite the attempt to comply.
  1. If the defect is minor, the consumer cannot obtain termination of the contract.
  2. Any period of immobilization of the property suspends the legal guarantee until delivery of the property restored to conformity.
  3. Any professional who obstructs the implementation of this guarantee is liable to a civil fine of up to €300,000 or 10% of average annual turnover (art. L.241-5).

B. Legal guarantee against hidden defects (Civil Code, arts. 1641 to 1649)

  1. The consumer has a period of 2 years from the discovery of the defect to take action.
  2. He can choose between:
  • keep the property and obtain a reduction in the price;
  • return the property and obtain a full refund.
